The User of the website (hereinafter referred to as "User") must carefully read and agree to the following terms and conditions, including any future amendments (hereinafter collectively referred to as the "Terms & Conditions") before using the website www.bidnbid.com (hereinafter referred to as "website"). The user herein shall mean and include buyer/ bidder and the entity or individual using the Website. By using the website Users are accepting to be bound by the provisions of these terms & conditions, the privacy policy of the HT Media Limited (hereinafter referred to as "HTML") and service agreement by HTML.

  • These Terms and Conditions and the Privacy Policy Statement which are hereby incorporated as if set forth fully herein, represent the complete agreement between User and the HTML for the use of and access to the Services and/or other contents of this website.
  • At the time of registration the User must be at least eighteen years old. HTML reserves the right to refuse service/registration to any person at any point of time without giving any prior notice and without assigning any reason whatsoever.
  • HTML authorizes User to view and access of the content available on or from the website solely for their personal use. The contents of the website and of all other websites under HTML's control, whether partial or otherwise such as text, graphics, images, logos, button icons, software and other contents as well as compilation of contents (meaning the collection, arrangement and assembly), are property of HTML and are protected under both India and foreign copyright, trademark and other laws.   • We will facilitate to arrange a visit for the interested buyers to physically verify the property at a pre-agreed date. Any customer ( whether a buyer or a seller) who participates in the bidding process implies his willingness to take part in this activity. Further to this, HTML will not be responsible for any loss or damages occurred to person or property during or after the visit to the property of interest.
  • We will share your personal details - name, mobile number, email id and all the information regarding your property to interested bidders and sellers, not restricted to those who have won the auction. Your acceptance to participate in the bidding process confirms your consent to the same.
  • For any person to register as a buyer/seller on the website, he must upload his/her government approved set of identification on the website. Any indication of a forged/ fake identification document submitted at the website automatically annuls the contractual agreement between the client and the website.
  • User shall be solely responsible for maintaining the confidentiality of their account and passwords. The User shall be solely responsible for all activities happening under his/her Username whether authorized or not. User agrees to immediately notify HTML of any unauthorized use of USER's Account and Password.
  • HTML reserves the right to modify, suspend, cancel, discontinue or terminate the Services of the website or reject any or all entries/blogs at their absolute discretion without giving any prior notice and without assigning any reason whatsoever and without any liability to the User.
  • User shall be responsible for use of the website, for any entries/posts/documents that he/she uploads/makes, and for any consequences arising thereof. The User agrees that he/she shall use the website in accordance with all laws, rules and regulations, as applicable from time to time, including without limitation IT laws and laws relating to unfair competition, antidiscrimination, cheating/fraud, false advertising and defamation. The User further agrees that the usage of website by the User shall not violate any third party rights including but not limited to Intellectual Property Rights, Right of Privacy and Right of Publicity. Any violation of any of the foregoing, including the terms and conditions mentioned herein shall result in immediate termination of this Agreement, Moreover, HTML reserves the right to seek damages from any such User to the extent permitted by law for any violation of laws applicable.
  • User represent and warrant that it owns or otherwise control all of the rights to the content/documents/information submitted on the Website and that it will not violate the Service Terms or cause injury to any other person or entity. HTML takes no responsibility and assume no liability for any material, documentation, content, opinion, recommendation, or advice submitted by User or any third party. HTML has no obligation to post any content/documentation/information provide by User, and reserve the right to post its own versions of that content/information (including, but not limited to, photos of properties or property descriptions) instead of User's in HTML's sole discretion.
  • User assign HTML the right to pursue enforcement of copyright and other intellectual property claims against third parties that have, without authorization, and in violation of the Service Terms, scraped, copied, or distributed content from the Services that has been provided to HTML by User and for which User have not granted such third parties a separate license to use.
  • Users are also prohibited from violating or attempting to violate the security of website, including, without limitation the following activities: (a) accessing data not intended for such User or logging into a server or account which the User is not authorized to access; (b) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization; (c) attempting to interfere with service to any User, host or network, including, without limitation, via means of submitting a virus to website, overloading, "flooding", "spamming", "mail bombing" or "crashing"; or (d) forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting. Violations of system or network security may result in civil or criminal liability. HTML will investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting Users who are involved in such violations.
  • The contents/documents of specific postings made by the User are the responsibility of the User who makes such postings. Though HTML reserves the right to filter out postings which may carry offensive, harmful, inaccurate, pornographic content or content which infringes on the Intellectual Property Rights of any third party or any rights of publicity or privacy or is defamatory, libelous, threatening or harassing or is indecent and contains any viruses, trojan horses, trap doors, back doors, easter eggs, worms, time bombs, cancelbots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information or otherwise inappropriate content, it does not take any responsibility for such content and/or for deceptive, mislabeled or defamatory content.   • The contents/documents, views and ideas expressed/posted are of the respective Users and HTML does not support/endorse any such views, ideas and expressions. Moreover, HTML does not represent or guarantee the truthfulness, accuracy, or reliability of any such postings/blogs posted by the Users, the ability of Seller to offer property to Buyers/bidders or any document/information/pictures/content related to property or Bidder information or genuineness of the Buyer and/or Bidder and makes no representations about any property listed/documents available/ information related to properties listed or uploaded on the Website or buyer or seller or bidder or any other related information on the website. The Users are cautioned to enquire in their personal capacity or use common sense and proper judgment with respect to any information/documentation available on the website. HTML is merely providing a platform to the Users for the purposes of buying and selling its properties and is not involved in the any transaction between Seller, buyer or bidder, in any manner whatsoever. Any reliance on the content/documentation/information posted by other Users using the website shall be entirely at the risk of the User. User understand and confirm that using and acting in pursuance of information and documentation on the Website can accrue risks, including but not limited to the risk of physical harm, of dealing with strangers, foreign nationals, underage persons or people acting under false or with intent to cheat or defraud.
  • HTML reserves the right without prior notice to access, read preserve and/or disclose the personal information of the User including the content of the postings/blogs if the same is required:1) in order to comply with any court judgment/decree/order/directive,2) by any legal/government authority;3) by applicable law;4) by professional/legal advisers, directors, employees/agents/representatives of HTML in connection with this Agreement or otherwise;5) for investigating potential violations of the terms herein or applicable national & international laws;6) for investigating deliberate damage to the Services or its legitimate operation;7) for responding to service support requests, or8) for protecting the rights, property or safety of HTML and/or its Directors, employees and the general public at large.
  • HTML reserves the right to store and process the personal information provided by the User in India or any other country where HTML or its agents/representatives/group companies maintain storage and processing facilities and the User by using the services herein consents to any such transfer of information outside India without prior notice.
  • HTML shall not be liable or responsible in any manner whatsoever for deletion and/or failure to transmit or store any information/documentation/content posted by the User by using the Services herein or personal information provided by the User or any other communication maintained by the Service. Further, HTML reserves the right to create limits on use of the said Service and storage at its sole discretion without assigning any reason whatsoever and without giving any prior notice.
  • USER AGREE THAT THE USE OF THE SERVICES IS AT USER's SOLE RISK AND ACKNOWLEDGE THAT ALL INFORMATION CONTAINED IN THE SERVICES IS PROVIDED "AS IS" AND "AS AVAILABLE," AND THAT HTML DISCLAIM ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, AS TO THE SERVICES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. HTML makes no representations or guarantees that the Services are compatible with USER's equipment or that the Services, or that any electronic communications sent by HTML or its affiliates, are error-free or will be free from loss, destruction, damage, interruption, corruption, attack, viruses, worms, or other harmful, invasive, or corrupted files, interference, hacking, or other security intrusion, and HTML disclaim any liability relating thereto. User agrees that HTML have the right to change the content or technical specifications of any aspect of the Services at any time in its sole discretion. User further agrees that such changes may result in Users being unable to access the Services.
  • HTML make no guarantees, representations, or warranties that the Services or information available through the Services, or that the use of or result of the use of the Services, will be accurate, reliable, complete, current, uninterrupted, or without errors. Any documents, pictures, documentation, or other information available on the Services are for informational purposes only, and may not represent the current condition of a property or the condition of the property at the time of sale. The posting of pictures on the Services does not constitute a guarantee that any items represented in the pictures will be present when a buyer takes possession of a property. Users are encouraged to conduct their own due diligence and investigate all matters relating to any properties. It is recommended that user shall seek independent advice, including legal advice, to perform the due diligence and use good faith efforts in determining that the content of all information provided to or obtained by User is accurate.
  • HTML does not warrant that website will operate without any technical error and is free from any computer viruses or other harmful mechanisms. HTML shall not be liable in any manner whatsoever for any consequences, claims, damages, costs etc. arising out of any of the above-said reasons or due to any force majeure factors and/or due to any reasons beyond the control of HTML. HTML to the fullest extent permitted by law, disclaims all warranties, whether express or implied, including the warranty of merchantability, fitness for particular purpose and non-infringement. HTML makes no warranties about the accuracy, reliability, completeness, or timeliness of the content, services, software, text, graphics, and links used on the website.
  • HTML's maximum liability arising out of or in connection with the website or User's use of the HTML's Services/Website, regardless of the cause of action (whether in contract, tort, breach of warranty or otherwise), will not exceed INR Rs. 50,000/-
  • HTML shall not be responsible or liable in any manner whatsoever for the exercise or non-exercise of its rights herein.
  • All HTML trade names, trademarks, logos, domain names including without limitation www.bidnbid.com, all content on www.bidnbid.com, are the exclusive property of HTML and the User shall not use the same without the prior written permission of HTML.
  • HTML reserves the right in its sole discretion to investigate and take legal action against anyone who engages in any illegal or prohibited conduct or otherwise violates these Terms of Use, including without limitation, removing the User Content from the website and/or terminating the offending User's ability to access the website and/or use HTML's services. HTML may take any other action with respect to User Content or User actions that it deems necessary or appropriate in its sole discretion if it believes it may create liability for the HTML or may cause the HTML to lose (in whole or in part) the services of its ISPs or other suppliers.
  • The User agrees to indemnify HTML and its directors, employees and agents against any third party claim, action, suit or proceeding resulting from his use of the Services herein or arising out of the Content/documentation/information submitted, posted, transmitted or otherwise made available by the User while using the website, or use of the website by the User in violation of these terms & conditions or violation of any third party rights by the User.
  • HTML reserves the right, in its sole discretion, to amend or revise these terms & conditions at any point of time, without prior notice and the User agrees to be bound by such amendments or revisions. It is therefore suggested that the User must periodically review the updated version of these terms & conditions at www.bidnbid.com.
  • All the disputes arising between the User and HTML is to be governed by and construed in accordance with the laws of India. The Courts/Tribunals at Delhi/New Delhi shall have the exclusive jurisdiction over any disputes relating to the subject matter of this Agreement.
  • User hereby express that it has no objection upon any call/SMS/Communication by HT MEDIA LIMITED, any third party on its behalf or any other party authorized by HT MEDIA LIMITED, communicating to User with regard to the Shine.com Services like Job Search, Job Alert, Shine Career Services etc.. Notwithstanding User's registration with National Do Not Call Registry (In Fully or Partly blocked category under National Customer Preference Register set up under Telecom Regulatory Authority of India), User hereby expresses his interest and accord its willful consent to receive communication (including commercial communication) in relation to www.bidnbid.com Services. User further confirms that any communication, as mentioned hereinabove, shall not be construed as Unsolicited Commercial Communication under the TRAI guidelines and User has specifically opted to receive communication in this regard on the telephone number provided by the User.
